1. Binding Agreement

Contracted Rates Terms and Conditions:
Please read through the following terms and conditions. Using these rates binds you to these terms and conditions.

Please note that the terms and conditions vary slightly between Puerto Galera and Dumaguete Resorts and the liveaboard, Azores.

Do not hesitate to contact us if you should have any questions.


2. Validity

- Atlantis Puerto Galera and Dumaguete Resorts - Rates are valid from the date sent to the periods shown.
- Atlantis Azores - Rates are valid for date periods shown on the rate sheets.
- These "Terms & Conditions" are effective immediately and until further notice. They
also supersede any previous versions.

For advance bookings beyond listed periods add 5% per year to existing vacation rates. These rates can only be 'locked in' with a deposit within 30 days of the reservation in line with the terms below. 'Locked in' rates only apply to the liveaboard or resort vacations and do not apply to transfers, flights or add-on items including marine park fees and Nitrox.


3. Information and Arrival Preparation

Pre Check-In Requirements -
1. We ask that all guests pre check in online at: https://booking.atlantishotel.com/online_forms.html at least 7 days prior to arrival. For guests unable to register online, we can send PDF files to be returned via email or fax. This is a pre- arrival requirement and does reduce the paperwork and time required to check guests in. If you
would like copies of the guest information please let us know. The pre check-in forms do include important liability and insurance information, which needs to be acknowledged prior to arrival.

2. We will send you our Frequently Asked Questions (FAQ) sheets for the resorts and liveaboard as well as 'meet and greet' information for guest arrivals. Please kindly ensure
that all guests have copies of these documents. Additional information such as room maps can be provided on request or found at the download section of our web site at: http://www.atlantishotel.com/guestcorner/downloads.php

3. We do require -
a) A full list of guest names as written in their passports and
b) International arrival and departure details at least 60 days prior to arrival along with
your balance of payments.

4. Please be sure that room requests specify whether the guests require one or two beds in the room.

Communication and Reservation Details
All quotes that we provide are in writing and all reservations, cancellations or booking amendments must be confirmed in writing.

Travel Vouchers
Please issue a travel voucher for every booking. Guests are requested to show voucher upon arrival; the voucher must show as a minimum:
- Guest name(s)
- Clearly indicate the specific services that you purchased from Atlantis
- Clearly indicate that these services are non-transferable, non-refundable and have no
cash value
- Display adequate contact details of the Atlantis Resort(s)


4. Diving

General
1. Unlimited diving: Diving includes all day and night diving within the daily schedule (typically up to 5 dives per day - including night dive).
2. Diving is as described and where not stated otherwise includes tanks, weights, boat and guide; it excludes equipment rental, day trips and Nitrox fills.
3. Divers are required to show a logbook and/or certification card before diving?
4. The first dive of the vacation is an 'orientation dive' to assess diver's ability and orientate them to procedures and the local area
5. All dives are guided and divers will be required to follow standard safe diving practices (please contact us for details)
6. For recreational dives the maximum depth is 30m/100ft and the maximum dive time is 60 minutes (please ask for tailored dive profiles with longer or personalized dives)
7. To participate in night dives or dives below 18m/60ft divers are required to show experience/certification in night/deep diving or take the PADI Adventure Night/Deep Dive Module (this applies for resorts and liveaboard diving).
8. Diving does not include Marine Park/Sanctuary fees. See rates.
9. Please note that the use of dive computers is mandatory on the Azores and every diver
must have visible (e.g. signal tube) and audible (e.g. whistle) surface signaling devices -
this is also highly recommended for resort diving
10. If dive days are cancelled or curtailed due to weather there is no reimbursement or compensation.

Diving Day Trips
Two Apo (or other) Island day trips are included in standard Dumaguete Resort 7 night vacations.

Some other day trip locations are only suitable for more advanced/experienced divers. In these cases please only pre book day trips for divers with Advanced Certification and at least twenty logged dives; other divers will be assessed at the resort.

Dive Courses
1. Dive course rates exclude required student materials and certification.
2. Dive courses in Dumaguete are subject to a $15 per day marine park fee.
3. Introductory courses (Scuba Diver and Open Water) and discover programs include
rental equipment. Other courses do not include rental equipment.
4. For Divemaster training and internships marine park fees are not included in
Dumaguete.

5. Payments and Cancellation Terms

All payments are made in advance of guest arrival and subject to our cancellation terms and conditions. If for any reason payment is not made prior to a guest's arrival please contact us to avoid complications. Check in requests with unpaid vouchers will not normally be honored.

Atlantis Puerto Galera and Dumaguete Resorts

Payments for Groups at the Resorts (a group is defined as any number of guests that generates a free space)
1. First Payment: Deposit of $100 per paying person (and per resort for combo bookings) within thirty (30) days of reservation
2. Second Payment: None
3. Third payment: 180 days. Additional amount to bring total payments to 40% of total
vacation price
4. Final balance of payment: 60 days prior to arrival

Cancellation Penalty for Groups at the Resorts
- 180 days or more is loss of deposit
- 179-61 days before arrival is 10% of the total vacation price
- 60 - 31 days before arrival is 30% of the total vacation price
- 30 - 03 days before arrival is 80% of the total vacation price
- From 2 days before arrival date is 100% of the total vacation price
** Penalties are based on "rack rates". No penalty on unused transfers. However if domestic flights have been booked then full penalty applies.

Payments for FITs at the Resorts (non-groups)
1. Deposit: 20% of vacation price within thirty (30) days of reservation
2. Second Payment: None
3. Third payment: None
4. Balance of Payment: 60 days prior to arrival

Cancellation Penalty for FITs at the Resorts
- 181 days plus - refundable (less bank charges) or creditable towards another trip
- 181-61 days before arrival is 10% of the total vacation price
- 60 - 31 days before arrival is 20% of the total vacation price
- 30 - 03 days before arrival is 80% of the total vacation price
- From 2 days before arrival date is 100% of the total vacation price
** Penalties are based on "rack rates". No penalty on unused transfers. However if domestic flights have been booked then full penalty applies.

Atlantis Azores

Payment for Groups on Azores (group is defined as any number of guests that generates a free space).
Normally for Azores, groups are given 1 FOC for 7 paying and 2 FOCS for 14 paying for 7 night itineraries. For any charter of more than 7 nights, the minimum for an FOC is 9 paying with 1 FOC and 14 paying with 2 FOCs. Note: If a group is booked, they are financially responsible for the minimum number paid to generate a free space.

1. First payment: Non refundable deposit of $200 per paying person within 30 days of reservation. For resort combo reservations, additional $100 per person per resort.
2. Second Payment: 270 days - additional non-refundable payment of $3,500. Upon receipt of second payment ($3,500) full charters may be reduced to the minimum number of places thath generates an FOC up to 270 days with amount paid fully credited towards these places. At 270 days prior to arrival the group is financially responsible for the total number of paid spaces for which they have committed.
3. Third payment: 180 days. Additional amount to bring total payments to 40% of the total vacation price.
4. Final balance of payment: 60 days prior to departure

Cancellation Penalty for Groups on Azores
- 271 days plus is loss of deposit
- 270 or less to arrival date is 100% of the total charter price

Payments for FITs on Azores (non-groups)
1. Deposit: 20% of charter price within thirty (30) days of reservation 2. Second Payment: None
3. Third Payment: None
4. Balance of Payment: 60 days prior to departure
Cancellation Penalty for FITs on Azores
- 61 days or more before arrival is 20% of the total charter price
- 60 days or less before arrival date is 100% of the total charter price

Azores Trip Cancellation and Change of Itinerary

ALL CHARTERS
Insurance is highly recommended to cover unforeseen eventualities and your clients must be aware of this. Atlantis will provide the following assistance in the event of trip cancellations
If a complete trip is cancelled due to inclement weather and Azores does not leave port guests are entitled to a credit of $1,770* (2015) valid for 12 months from the date of departure. The credit may be applied to any Azores or Resort booking during that period including applying it immediately to a stay at either resort subject to availability.

If weather forces Azores to return to port (at any point after the yacht has left) the trip is considered cancelled. Guests are entitled to a credit of $230 per unused night valid for 12 months from the date of departure. The credit may be applied to any Azores or Resort booking during that period including applying it immediately to a stay at either resort subject to availability.
If dive days are cancelled or curtailed due to weather there is no reimbursement or compensation

Change of Itinerary:
Every effort will be made to follow proposed routes and dive sites. However, the final itinerary and locations are at the discretion of the Captain and these may change according to weather, safety, or other logistical issues.

*Credit applied to accommodation, meals and diving.

Quotation Checks

This rate listing and the information presented here to serve as reference for each quotation/reservation with Atlantis. Please double-check each quotation against this rate sheet. In the event our reservations team miscalculates we will use this list as a reference to correct wrong quotes and balance payments.

Payments
Please email us wire transfer bank receipts and group/client names so your payment can be correctly credited. Bank account details are available with the rates you are sent. Please note that only the amount that arrives into our account will be credited towards your invoice. Wire transfers must be in US Dollars (USD).

Insurance
Atlantis highly recommends adequate travel insurance for ALL our guests. Insurance should cover travel, health and diving. During the online check-in process, guests will be able to
purchase dive, health and travel insurance from Dive Assure to cover this trip specifically at a much reduced cost. Weather conditions, health problems and many other unforeseen reasons can change travel plans and/or cause financial losses that should be insured against.

Cancellations, losses and disruptions caused by reasons outside of Atlantis' responsibility must be shouldered by clients or insurance. Atlantis will provide adequate 'paperwork' to support guests claims for insurance payments.


6. Toko's Restaurant

Dietary Requirements: Please advise our reservations team of any special dietary requirements
via the online check-in form.

Christmas Season Meals: Please note that bookings on December 24th and/or December 31st will have a special festive meal automatically added to the package.

Complimentary Open Bar for Local Drinks:
Azores vacations include complimentary local drinks. The following drinks are available throughout the charter free of charge: fresh blended juice, calamansi (local citrus fruit) juice, ice tea, coffee, selection of tea, milk, filtered drinking water (not bottled), Coke, Coke Zero, and Sprite. Additionally, social servings of San Miguel Pale Pilsen, San Miguel Light, Tanduay (local) rhum and wine with dinner are included. Guests are welcome to bring their own drinks aboard Azores.

Resort vacations (all inclusive only) include complimentary brewed coffee (Italian and Specialty coffees are not included), a selection of tea, coffee or ice tea and filtered water from 6am to 6pm. Other beverages are charged to their personal account and corkage will be charged to any beverages purchased outside the resort & consumed on site.

Please also remind clients that we do not allow diving after the consumption of any alcohol (either on the boat or at the resorts) and that on boarding the boat alcohol will not be served until the trip safety briefing is complete.


7. Transfers

General
A part of the 'Atlantis Service' is concierge guest travel arrangements that include land, water and air transfers. This enables us to provide this highest level of guest care possible throughout a guest's stay. Atlantis does so to avoid guest inconvenience and to make their trip to the Philippines seamless and as easy as possible.

If our guests or agents arrange their own transfers Atlantis cannot be held responsible when complications arise. If requested to assist in transfers we have not arranged and/or ticketed we have no choice but to charge a minimum service fee of $40 per person in addition to any hard costs incurred in making changes, such as rebooking fees.

Due to continuity issues, Atlantis must arrange all transfers associated with all Azores reservations.

Group Transfers
Group transfer rates apply when the entire group travels together. Full supplemental charges apply to those travelling at other times or to other locations. 'Manila' refers to Ninoy Aquino International Airport, Domestic Airport or Makati City - additional charges may apply to pick- ups or drop-offs in other areas or for unscheduled or lengthy stops.

Service Providers
Atlantis charters local van and boat transfer services. These services adhere to Atlantis' standard quality outlines however we are not liable for such services. The transfer services are monitored by phone before guest arrival until they have reached their destination. Schedules of domestic airlines and ferry services along with terminal and excess baggage fees can change without prior notice. Please confirm schedules and rates with us for each booking.

Please note: Atlantis will not be liable for additional expenses incurred due to delays, interruptions, cancellations or other problems with public ferries or airlines (see insurance section of these terms).

Domestic Flight Reservations

Group Bookings (10+ passengers travelling on the same flights (booked at the same time))
To hold a group reservation we need the following
1. A confirmed reservation at the resort or liveaboard with a deposit paid.
2. Details of international inbound and outbound flights and/or sufficient information
regarding which flight to hold on which day.

We need this information as early as possible and no later than 60 days prior to the arrival date.
Final passport name lists (please ask guest to complete our online check in process) for groups can be provided at 60 days

FIT Bookings (9 or less passengers)
To make a reservation we need -
1. The names of the guests as they appear in their passport (please ask guest to complete our online check in process).
2. A confirmed reservation at the resort or liveaboard with a deposit paid.
3. Details of international inbound and outbound flights and/or sufficient information
regarding which flight to hold on which day.

We need this information as early as possible and no later than 60 days prior to the arrival date.

Domestic flight prices may be subject to change without prior notice; we try and avoid this by asking you to provide the above information as early as possible.

Once domestic flight reservations have been made the transfer portion of the guest bill is non refundable.

Tickets are not transferrable.

For reservations made within 60 days supplemental charges will apply (please note that domestic flights during peak seasons can be up to three or even four times the prices we quote on our rate sheets).

Check-in Baggage Allowance and Excess Baggage with Domestic Airlines
Note: Domestic carries strictly enforce a maximum of 7Kg/15lbs for hand carried luggage

CEBU PACIFIC
Our domestic tickets on Cebu Pacific include 30Kg/66lbs. This can be upgraded to a total of:
40kg/88lbs total - $40 round trip add on
55Kg/121lbs total - $105 round trip add on
60Kg/132lbs total - $115 round trip add on
70Kg/154lbs total - $130 round trip add on
80Kg/176lbs total - $150 round trip add on.

Note: Maximum weight per bag should not exceed 35kgs.
Confirmation of weight requirements must be given at least 60 days prior to arrival.
At the airport, excess baggage is charged at Php225.00 (about $6 USD) per kilo (2.2 lbs) and must be paid in cash (Php). This can change as this is set by the airlines.

PAL EXPRESSS
For PAL Express our domestic tickets include 10Kg/22lbs. This can be upgraded to a total of
25Kg/55lbs (additional 15kg/33lbs) for *$42.50 each segment
*upgrade availability is subject to ticket type. PAL is no longer offering the Sports Plus card.

Confirmation of weight requirements must be given at least 60 days prior to arrival.

At the airport, excess baggage is charged at Php225.00 (about $6 USD) per kilo (2.2 lbs) and must be paid in cash (Php). This can change as this is set by the airlines.

Additional luggage fees for both airlines may be charged to personal bills at the resort


8. Miscellaneous

Marine Park Fees
Guests are responsible for paying marine park fees on their personal bill as they are established at the time of their stay; as these fees are set by local Municipalities they can change at any time.

Cash Advances, Credit Card Use and Gratuities
Please ensure that your clients are aware of the following:
1. We cannot accept tips paid by credit card so please bring ample cash (any major currency) if you intend to tip.
2. We cannot provide cash advances through credit cards; please check with us for up-to- date ATM availability at each location.
3. There is a 5% discount for cash payments on personal bills at the resort.

Arrival and Departure Days
Resorts: The Saturday to Saturday rule applies to all group bookings and may apply to FIT bookings depending on expected occupancy levels. We may have some latitude in regards to this policy during a promo period. For groups staying longer or shorter than 7 nights, groups must either arrive or depart on a Saturday.

Azores: All Azores charters run Saturday to Saturday with the exception of 10 and 12 night Cebu-Malapascua charters.

Single Supplements and non-divers on Azores
For Azores full boat charters, 2 single supplements and 2 non-divers are allowed. For a half boat Azores charter one single supplement and one non-diver are allowed.

Internet
Vacations include free Internet use. This is also available on the Azores depending on location/reception.


Children

Atlantis Puerto Galera and Dumaguete Resorts
- Infants 0-4 years old are FOC at the resorts on accommodation and meals when rooming with a parent or adult
- Child rates apply between the ages of 5 and 11 (please ask for children's rates if needed)
- Children over the age of 12 are considered as adults for pricing purposes

Azores
- The Azores does not accept children under the age of 15 on dive charters.
- Adult rates apply to all places.

Upon receipt of second payment ($3,500) full charters may be reduced to the minimum number of places thath generates an FOC up to 270 days with amount paid fully credited towards these places. At 270 days prior to arrival the group is financially responsible for the total number of paid spaces for which they have committed.
3. Third payment: 180 days. Additional amount to bring total payments to 40% of the total vacation price.
4. Final balance of payment: 60 days prior to departure

Cancellation Penalty for Groups on Azores
- 271 days plus is loss of deposit
- 270 or less to arrival date is 100% of the total charter price

Payments for FITs on Azores (non-groups)
1. Deposit: 20% of charter price within thirty (30) days of reservation 2. Second Payment: None

Azores Trip Cancellation and Change of Itinerary

ALL CHARTERS
Insurance is highly recommended to cover unforeseen eventualities and your clients must be aware of this. Atlantis will provide the following assistance in the event of trip cancellations
If a complete trip is cancelled due to inclement weather and Azores does not leave port guests are entitled to a credit of $1,770* (2015) valid for 12 months from the date of departure. The credit may be applied to any Azores or Resort booking during that period including applying it immediately to a stay at either resort subject to availability.

If weather forces Azores to return to port (at any point after the yacht has left) the trip is considered cancelled. Guests are entitled to a credit of $230 per unused night valid for 12 months from the date of departure. The credit may be applied to any Azores or Resort booking during that period including applying it immediately to a stay at either resort subject to availability.
If dive days are cancelled or curtailed due to weather there is no reimbursement or compensation

Change of Itinerary:
Every effort will be made to follow proposed routes and dive sites. However, the final itinerary and locations are at the discretion of the Captain and these may change according to weather, safety, or other logistical issues.

*Credit applied to accommodation, meals and diving.

Quotation Checks

This rate listing and the information presented here to serve as reference for each quotation/reservation with Atlantis. Please double-check each quotation against this rate sheet. In the event our reservations team miscalculates we will use this list as a reference to correct wrong quotes and balance payments.

Payments
Please email us wire transfer bank receipts and group/client names so your payment can be correctly credited. Bank account details are available with the rates you are sent. Please note that only the amount that arrives into our account will be credited towards your invoice. Wire transfers must be in US Dollars (USD).

Insurance
Atlantis highly recommends adequate travel insurance for ALL our guests. Insurance should cover travel, health and diving. During the online check-in process, guests will be able to
purchase dive, health and travel insurance from Dive Assure to cover this trip specifically at a much reduced cost. Weather conditions, health problems and many other unforeseen reasons can change travel plans and/or cause financial losses that should be insured against.

Cancellations, losses and disruptions caused by reasons outside of Atlantis' responsibility must be shouldered by clients or insurance. Atlantis will provide adequate 'paperwork' to support guests claims for insurance payments.


6. Toko's Restaurant

Dietary Requirements: Please advise our reservations team of any special dietary requirements
via the online check-in form.

Christmas Season Meals: Please note that bookings on December 24th and/or December 31st will have a special festive meal automatically added to the package.

Complimentary Open Bar for Local Drinks:
Azores vacations include complimentary local drinks. The following drinks are available throughout the charter free of charge: fresh blended juice, calamansi (local citrus fruit) juice, ice tea, coffee, selection of tea, milk, filtered drinking water (not bottled), Coke, Coke Zero, and Sprite. Additionally, social servings of San Miguel Pale Pilsen, San Miguel Light, Tanduay (local) rhum and wine with dinner are included. Guests are welcome to bring their own drinks aboard Azores.

Resort vacations (all inclusive only) include complimentary brewed coffee (Italian and Specialty coffees are not included), a selection of tea, coffee or ice tea and filtered water from 6am to 6pm. Other beverages are charged to their personal account and corkage will be charged to any beverages purchased outside the resort & consumed on site.

Please also remind clients that we do not allow diving after the consumption of any alcohol (either on the boat or at the resorts) and that on boarding the boat alcohol will not be served until the trip safety briefing is complete.


7. Transfers

General
A part of the 'Atlantis Service' is concierge guest travel arrangements that include land, water and air transfers. This enables us to provide this highest level of guest care possible throughout a guest's stay. Atlantis does so to avoid guest inconvenience and to make their trip to the Philippines seamless and as easy as possible.

If our guests or agents arrange their own transfers Atlantis cannot be held responsible when complications arise. If requested to assist in transfers we have not arranged and/or ticketed we have no choice but to charge a minimum service fee of $40 per person in addition to any hard costs incurred in making changes, such as rebooking fees.

Due to continuity issues, Atlantis must arrange all transfers associated with all Azores reservations.

Group Transfers
Group transfer rates apply when the entire group travels together. Full supplemental charges apply to those travelling at other times or to other locations. 'Manila' refers to Ninoy Aquino International Airport, Domestic Airport or Makati City - additional charges may apply to pick- ups or drop-offs in other areas or for unscheduled or lengthy stops.

Service Providers
Atlantis charters local van and boat transfer services. These services adhere to Atlantis' standard quality outlines however we are not liable for such services. The transfer services are monitored by phone before guest arrival until they have reached their destination. Schedules of domestic airlines and ferry services along with terminal and excess baggage fees can change without prior notice. Please confirm schedules and rates with us for each booking.

Please note: Atlantis will not be liable for additional expenses incurred due to delays, interruptions, cancellations or other problems with public ferries or airlines (see insurance section of these terms).

Domestic Flight Reservations

Group Bookings (10+ passengers travelling on the same flights (booked at the same time))
To hold a group reservation we need the following
1. A confirmed reservation at the resort or liveaboard with a deposit paid.
2. Details of international inbound and outbound flights and/or sufficient information
regarding which flight to hold on which day.

We need this information as early as possible and no later than 60 days prior to the arrival date.
Final passport name lists (please ask guest to complete our online check in process) for groups can be provided at 60 days

FIT Bookings (9 or less passengers)
To make a reservation we need -
1. The names of the guests as they appear in their passport (please ask guest to complete our online check in process).
2. A confirmed reservation at the resort or liveaboard with a deposit paid.
3. Details of international inbound and outbound flights and/or sufficient information
regarding which flight to hold on which day.

We need this information as early as possible and no later than 60 days prior to the arrival date.

Domestic flight prices may be subject to change without prior notice; we try and avoid this by asking you to provide the above information as early as possible.

Once domestic flight reservations have been made the transfer portion of the guest bill is non refundable.

Tickets are not transferrable.

For reservations made within 60 days supplemental charges will apply (please note that domestic flights during peak seasons can be up to three or even four times the prices we quote on our rate sheets).

Check-in Baggage Allowance and Excess Baggage with Domestic Airlines
Note: Domestic carries strictly enforce a maximum of 7Kg/15lbs for hand carried luggage

CEBU PACIFIC
Our domestic tickets on Cebu Pacific include 30Kg/66lbs. This can be upgraded to a total of:
40kg/88lbs total - $40 round trip add on
55Kg/121lbs total - $105 round trip add on
60Kg/132lbs total - $115 round trip add on
70Kg/154lbs total - $130 round trip add on
80Kg/176lbs total - $150 round trip add on.

Note: Maximum weight per bag should not exceed 35kgs.

PAL EXPRESSS

*upgrade availability is subject to ticket type. PAL is no longer offering the Sports Plus card.

Confirmation of weight requirements must be given at least 60 days prior to arrival.

8. Miscellaneous

Marine Park Fees
Guests are responsible for paying marine park fees on their personal bill as they are established at the time of their stay; as these fees are set by local Municipalities they can change at any time.

Cash Advances, Credit Card Use and Gratuities
Please ensure that your clients are aware of the following:
1. We cannot accept tips paid by credit card so please bring ample cash (any major currency) if you intend to tip.
2. We cannot provide cash advances through credit cards; please check with us for up-to- date ATM availability at each location.
3. There is a 5% discount for cash payments on personal bills at the resort.

Arrival and Departure Days
Resorts: The Saturday to Saturday rule applies to all group bookings and may apply to FIT bookings depending on expected occupancy levels. We may have some latitude in regards to this policy during a promo period. For groups staying longer or shorter than 7 nights, groups must either arrive or depart on a Saturday.

Azores: All Azores charters run Saturday to Saturday with the exception of 10 and 12 night Cebu-Malapascua charters.

Single Supplements and non-divers on Azores
For Azores full boat charters, 2 single supplements and 2 non-divers are allowed. For a half boat Azores charter one single supplement and one non-diver are allowed.

Internet
Vacations include free Internet use. This is also available on the Azores depending on location/reception.


Children

Atlantis Puerto Galera and Dumaguete Resorts
- Infants 0-4 years old are FOC at the resorts on accommodation and meals when rooming with a parent or adult
- Child rates apply between the ages of 5 and 11 (please ask for children's rates if needed)
- Children over the age of 12 are considered as adults for pricing purposes

Azores
- The Azores does not accept children under the age of 15 on dive charters.
- Adult rates apply to all places.
